1. Introduction

Welcome to BookaTicket, a service owned and operated by Rushivarya Solutions. By accessing our website and using our services, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree with these terms, you should not use our platform. If you do not accept these Terms and/or the Privacy Policy, you are not permitted to register, access, or use the Platform. If you are an individual acting on behalf of an entity, you represent and warrant that you have the authority to accept these Terms on behalf of such an entity. If you do not wish to accept the Terms stated herein, please do not register, access, or use the Platform/Services.

2. Definitions

• "Platform" refers to the BookaTicket website and services.
• "Organizer" refers to any entity or individual creating and managing events on the Platform.
• "User" or "Attendee" refers to anyone using the Platform to register for or attend events.
• "Services" refers to the ticketing, registration, and event management tools provided by BookaTicket.

3. Services Provided

BookaTicket grants Organizers a limited, non-exclusive license to use the Platform to create event pages, sell tickets, and manage registrations. We act solely as a technology provider. We do not organize, host, or manage the events listed on our website. BookaTicket reserves the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time with or without notice. You agree that BookaTicket shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform.

4. Age Restrictions

You must be at least 18 years old to use our Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or guardian.

5. User Restrictions

You agree to use the Platform only for lawful purposes. You shall not, and shall not authorize others to:

• Commercial Misuse: Sell, rent, lease, sub-license, or redistribute the Platform or Services without our prior written consent.
• Reverse Engineering: Disassemble, decompile, reverse engineer, or decrypt any part of the Platform or Services.
• Scraping & Automation: Use robots, spiders, scrapers, or other automated tools to access, acquire, copy, or monitor the Platform or its content.
• Security Violations: Attempt to gain unauthorized access, breach security measures, interfere with the proper working of the Platform (e.g., flooding, spamming, introducing viruses/malware), or probe/scan system vulnerabilities.
• Intellectual Property: Remove proprietary notices, copy/modify the Platform, or use BookaTicket's branding (logos, trademarks) without consent.
• Prohibited Content: Upload, transmit, or share content that is illegal, harmful, defamatory, obscene, pornographic, invasive of privacy, hateful, or infringes upon the rights of others.
• Data Misuse: Collect, harvest, or misuse information about other Users or Customers without their explicit consent.
• Unauthorized Access: Access data not intended for you or log into a server/account you are not authorized to access.

6. Payments and Fees

BookaTicket facilitates payments between Attendees and Organizers. We may charge a platform fee for our services, which is non-refundable. Organizers are responsible for any taxes associated with their events. BookaTicket is not a bank and does not hold funds on behalf of users longer than necessary to process transactions.

7. Organizer Payments and Payouts

• Payout Schedule: BookaTicket will transfer ticket proceeds (minus applicable fees) to the Organizer's designated bank account after the successful completion of the event. Standard payout processing time is 5-7 business days post-event.
• Account Information: Organizers are responsible for providing accurate and up-to-date bank account details. BookaTicket is not liable for payouts sent to incorrect accounts due to Organizer error.
• Taxes: Organizers are solely responsible for determining, collecting, and remitting any applicable taxes on ticket sales to the relevant authorities.

8. Platform Charges for Paid Events

• Platform Fee: BookaTicket charges a platform service fee on all paid ticket transactions. This fee covers payment processing, technology infrastructure, customer support, and platform maintenance.
• Fee Payment Options: When creating a paid event, Organizers must choose who will pay the platform fee:
  • Organizer Pays: The 10% fee is deducted from your ticket revenue. For example, for a ₹1,000 ticket, you receive ₹900 after the platform fee.
  • Participant Pays: The 10% fee is added to the ticket price at checkout. For example, for a ₹1,000 ticket, the attendee pays ₹1,100 (₹1,000 + ₹100 fee), and you receive the full ₹1,000.
• Mandatory Requirement: Platform charges are non-negotiable and mandatory for all paid events. By creating a paid event on BookaTicket, you acknowledge and agree to pay the platform fee as configured.
• Free Events: Events marked as "Free" (₹0 ticket price) are exempt from platform charges. No fees are deducted for free registrations.
• Fee Transparency: The platform fee structure and who pays it will be clearly displayed to attendees during the checkout process. You cannot hide or misrepresent this information.
• No Refund of Platform Fees: Platform fees are non-refundable, even if an event is cancelled or tickets are refunded to attendees. The fee covers services already rendered.
• Payment Gateway Charges: In addition to the platform fee, standard payment gateway charges (approx. 2-3%) apply to all transactions. These are separate from BookaTicket's platform fee and are charged by the payment processor.

9. Limitation of Liability

BookaTicket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Platform or attendance at any event. Our total liability for any claim shall not exceed the amount of fees paid by you to BookaTicket in the past 12 months.

BookaTicket is not a party to any agreement between Organizers and Attendees. You hereby release BookaTicket, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.

10. Event Disputes and Refunds

Because BookaTicket is not the organizer of the events, we are not responsible for the quality, safety, or legality of any event. Any disputes regarding refunds, cancellations, or event details must be resolved directly between the Attendee and the Organizer.

11. Indemnification

You agree to indemnify and hold BookaTicket harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Amravati, Maharashtra.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without prior notice. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
